1. Agreement
These Terms of Service (“Terms”) form a binding agreement between you (“you” or “User”) and CaptureMind (“CaptureMind,” “we,” “us,” or “our”) regarding your access to and use of the CaptureMind mobile app, this website, and any related services (collectively, the “Service”).
By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction to consent to digital services) to use the Service. By using the Service, you represent that you meet this requirement.
3. Your account
To use most features, you create an account using an email and password, or by signing in with Apple. You are responsible for:
- Maintaining the confidentiality of your credentials.
- All activity that happens under your account.
- Notifying us promptly at security@capturemind.app if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the Service to capture, store, or process content you don’t have a legal right to capture (for example, recording a meeting without the consent of participants where consent is required by law).
- Reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by law.
- Use the Service to harass, defame, or harm any individual.
- Probe, scan, or test the vulnerability of any system or network we operate.
- Bypass authentication, rate limits, or other security mechanisms.
- Use the Service to violate any applicable law or regulation.
Recording laws vary by jurisdiction. You are solely responsible for obtaining any consent required by law before recording a conversation.
5. AI provider keys
AI features require you to bring your own API key from a third-party provider (currently Google Gemini or Anthropic Claude). When you supply a key:
- You authorize CaptureMind to make API calls on your behalf using that key.
- You are responsible for charges incurred by the provider.
- You agree to the provider’s terms of service.
- We do not store your key on our servers; it lives in the iOS Keychain on your device.
If your provider rate-limits or rejects a request, the feature will fail gracefully. We are not liable for downtime, errors, or charges from the third-party provider.
6. Your content
You retain full ownership of your captures, summaries, transcripts, and any other content you create through the Service (“User Content”). We claim no rights over your content.
Because we don’t store your User Content on our servers, we cannot help you recover content that you deleted on-device.
7. Intellectual property
The Service, including the app, source code (where not open-sourced), brand, logos, and design, is owned by CaptureMind or its licensors and is protected by copyright, trademark, and other applicable laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes, subject to these Terms.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
AI-generated summaries, transcripts, and action items can be inaccurate, incomplete, or misleading. Do not rely on them as authoritative for legal, financial, medical, or any decision with material consequences.
9. Limitation of liability
To the maximum extent permitted by law, in no event shall CaptureMind be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim under these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
10. Indemnification
You agree to indemnify, defend, and hold harmless CaptureMind and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.
11. Termination
You may stop using the Service at any time by signing out and uninstalling the app, or by deleting your account in Settings → Account.
We may suspend or terminate your access to the Service if we believe you have violated these Terms or applicable law, or if continued provision becomes commercially impractical. Where reasonable, we will give you advance notice.
12. Changes to these Terms
We may revise these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the Service after a change constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-laws principles. Any dispute arising from these Terms shall be resolved exclusively in the courts of Ho Chi Minh City, Vietnam — except where applicable consumer-protection laws grant you the right to bring proceedings in your country of residence.
14. Apple App Store
The following terms apply when you obtain the app through the Apple App Store:
- These Terms are between you and CaptureMind only, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- Apple is not responsible for addressing claims relating to the app, including product liability, regulatory non-compliance, or consumer protection claims.
- If a third party claims the app or your use of it infringes their intellectual property rights, CaptureMind, not Apple, is responsible for investigation and resolution.
- You represent that you are not located in a country subject to a U.S. government embargo and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
